1. General

The general conditions of sale described below apply to all products sold through the E-Commerce site of Workshop Secrets. They define the rights and obligations of the parties.

Secrets d'Atelier reserves the right to modify the content and form of these general conditions of sale at any time.

2. Personal data

Secrets d'Atelier undertakes to respect the confidentiality of personal data communicated by customers on the E-Commerce site and to treat it according to legal obligations.

Customer data may be used by the internal services of Atelier Secrets:

• • For processing orders, deliveries and invoices

• • To inform upcoming sales and events by sending invitation emails

• • To strengthen and personalize communication with its customers, in particular by sending newsletters, special offers and other emails.

 

The customer is given the opportunity to refuse the sending by Workshop Secrets of emails of invitation or commercial communication, when he registers for the first time.

This functionality remains modifiable in his account at any time.

The customer undertakes to provide the personal information necessary for the management of his order (delivery and invoicing). These must be correct, valid and up to date.

The information relating to his identification and password must be kept secret by the client.

 

3. Sales process

3.1 Orders

Once the desired product is selected, it is placed in the "shopping cart" by the "Add to cart" button. The customer can then continue his selection of articles, modify his shopping cart or continue the ordering process and pay.

The validation of the order by the customer takes the place of acceptance of the general conditions of sale.

Once the order has been confirmed and paid for, the customer receives order confirmation information by email.

 

3.2. Price

The prices mentioned by article on the E-Commerce site are indicated all inclusive of tax and except costs of preparation or logistics routing. The shipping costs of the order will be indicated before the final validation of the order.

Secrets d'Atelier reserves the right to modify the prices and other costs displayed on the E-Commerce site without notice and at any time. However, the products will be invoiced to the customer on the basis of the prices in force at the time of validation of the order.

The customer benefits from the prices mentioned by article, valid in the country for which he can indicate a delivery address.

 

3.3. Product representation

Secrets d'Atelier undertakes to make the necessary efforts so that the photographic representation of the products offered for sale on the E-Commerce site is as faithful as possible to reality. However with regard to the mode of presentation of these products on the Internet, it is possible that the perception by the customer of the photographic representation of the products, in particular the colors of pigments does not correspond exactly to the products themselves.

 

3.4. Secure payments

Payment for purchases is made by means of a payment card.

The payment cards accepted to date are: Visa and MasterCard.

For customers delivered to Switzerland, payment by Post Finance is also possible.

The order will be considered effective after confirmation of the agreement of the bank payment centers.

In accordance with current regulations, and to ensure the security and confidentiality of their information, Secrets d'Atelier does not store the banking data of its customers. It is therefore up to the customer to save and print their payment certificate if they wish to keep the payment details relating to their order.

The payments managed by the Secrets d'Atelier E-Commerce site are subject to a security system of the highest level to date: PCI DSS level 1 certification. This international standard, established by the main market players (MasterCard, Visa, American Express, Discover Financial Services and JCB) governs security requirements for international payments:

3.5. Delivery

Shipping costs are calculated at the end of the order, depending on the recipient country. They are the responsibility of the customer and will therefore be invoiced at a flat rate 10CHF for Switzerland, 25CHF for other countries.

Secrets d'Atelier ships all goods sold through the E-Commerce site to Switzerland, mainland France and Germany. For other countries, the whole range of products will be available, with the exception of products classified as flammable.

The products and / or services will be sent to the delivery address that the customer has indicated during the ordering process.

From the order and confirmation of payment, the delivery times, given as an indication, are as follows:

• • 8 working days for Switzerland,

• • 15 working days for Europe

• • 30 working days for other countries.

Upon delivery, the invoice will be available on the E-Commerce site.

 

3.7. Guarantee of use

Secrets d'Atelier is in no way responsible for damage caused by improper use of its products; always refer to the technical, safety and operating instructions before using them.

 

3.8. Returns, withdrawal and refund

From the receipt of the product by the customer, the latter has a right of withdrawal, that is to say a period of 14 days to return the delivered product, the return costs being at his expense. Only products purchased through the E-Commerce site, and returned intact (unopened and in their original packaging) may be subject to a refund.

 

The procedure to follow is as follows:

• • The product must be accompanied:

  1. 1 The return request number provided in the previous step

  2. 2 A copy of the sales invoice

• • The product is checked by the internal services of Atelier Secrets who will validate or not the reimbursement, in particular by verifying that the product has been returned complete and in a condition suitable for re-marketing, as provided for in the right of withdrawal.

• • If the goods meet the return requirements, they may be subject to a refund

If the merchandise does not meet the return requirements, it will be returned to the customer who will not be able to obtain a refund.

 

4.Applicable law

These general conditions of sale, as well as any sale to which they apply, are subject to Swiss law. Any dispute arising out of, or in connection with these general conditions of sale or any sale to which these apply, will be settled according to Swiss law, whether this dispute is of a contractual or tort nature, or whether it is based on another clause. The application of the 1980 United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
